So, basically if I get a new I-94, am I in status again? Someone mentioned that you should be in status since your last arrival to the US. That was in 2004. So, i was under teh impression that I had to leave the country and return and things would be OK.

USCIS do have some checks and balances for the subst labor cases, so its not a staright approvals for the lab subst cases. their might be a possibility few lucky ones get off the hook, but overall USCIS can weed out the dubious/fraudulent employer petitions.
Sub labor is not the only reason guys, its just the country cap which is limiting india EB-3 and EB-2. Most of the H1Bs like us coming to us ends up applying for GC, now look at the number of H1Bs coming each year from india and the total number of GCs available for india. Their is a huge gap in these numbers, so unless they remove the country cap or recaptured unused VISA numbers from the past years, we dont see any relief.

Ok, so if I file the i-140/i-485 now and leave/re-enter the country with a new stamp. Now, if my I-140 is approved after that, and then my i-485 is looked at after that date, will I considered to be in status then, because by the time they are looking at the AOS application, I have already left and returned to the country??
Or should be in status the day the AOS petition is filed and even if i leave/re-enter the country after that, it does not matter?!
It appears that they look at status issues at the time the AOS petition is filed. That's when the "clock" stops. If you leave and re-enter the country it does not retroactively reset the "clock".

If it were for some of the antiimmigrant folks, my friend you (sugaur) wouldn't be here a day longer. you would be "out" in a wink from this country. so dont consider yourself too supportive of anti-immigration. Even citizens are favoring resolving the ilegal immigration crisis by granting some legality to those who are here ilegally. Dont support ilegal immigration but atleast dont bash those who show support to resolving this crisis. you and me are mere temporary visitors here. please remember that your country is not this. you are here seeking prosperity and so are they. this country has a way of dealing with them and us and neither has been satisfactory so far. I joined a small company right after graduating from a university in the US with a masters degree. At the time of joining, I was told orally that my GC will be processed in a timely manner. Being naive and timid, I did not press the issue and months became years before the employer agreed to file my labor after work for the company for 5 years (1 year of OPT right after school + 4 years of MS). Although I work in high-tech and would have qualified for RIR, the company lawyer convinced me to apply using the traditional route promising the entire process would take two years. Once again, being naive I agreed. Now, I am on my 8th year with the same company with my labor stuck in BEC, and no relief in sight. I can look forward to years more in the same position and same company! Sadly, though I am highly respected senior member of the company (in terms of knowledge and time with the company), people who joined after me and were trained by me, have gone on to Managerial positions, while I can only sit and watch.
I do not blame anyone or anything for my predicament, except my naivety. At least, I am glad for sources of information such as immigrationvoice, immigrationportal and immigration-law that have helped me immensely with my education on all matters immigration. Now, I feel I know more than my lawyer and cannot be convinced to take foolish decisions. So, it gladdens my heart to see that we in immigrationvoice seem to be having some impact on the lawmakers as it feels like I finally have control over changing my status quo.

Being an immigrant you have broken the law by hiring someone to work illegally. Didn't you and your wife break the law?
You have already witnessed a child abuse and now pondering whether to report this to a law enforcement or not. Again you are breaking the law by not reporting a child abuse. Remember, abetting a crime is also a crime.
This country has given us so much including good wealth and health(except GC) and we enjoy every thing, but in return what we do is to do these kind of illegal activities.
This country let us and our spouse to work, make hell lot of money. I am not saying we are making easy money, but after having two incomes, we run around with coupons and look for cheap things or do things that are cheap. WHY?
What are we going to do with that money man? This is nothing but a greediness.
Anyway, your child has gone thru a nightmare and as a parent/father you MUST report this to a law enforcement office. You can not let this child abuser go scot-free.
Note: When you can hire a nanny that is legal/citizen for $350/week, then why did you hire someone illegal?

I applied through a consultant for the masters quota and got a reject (I applied on the 4th of april) they have considered it as regular because the package did not contain a course completion letter (i will be graduating this may 4th, so all i could get was just unofficial transcripts.) Now the school agreed to give me a course completion letter.

My friend, Who said its not a problem? in my earlier post I have provided a big laundry list of Line cutting measures in place are these not problems? BUT the point is , is it worth it a fight ? Subs is long gone, We are fighting for Country quota from a year + atleast and we are still at square one and the problems keep worsens. We all worry about subs where there is no action. There is no fixing to this right now its a dead horse. Problem is VISA Numbers in XYZ,000's. Lets recapture them...

Law allows them to do that. is it not jealous to me ? The list grows...

Also, if you look at EB2, it is one of the highly abused category. The EB3 applicant who started in 2001 has joined the line half a decade before the one with 2006 Eb2 PD. One can't really accuse him/her for cutting the line just like one can about substitutes! If the EB3 porting case deserves merit, then I strongly support it!
My intention is not to to start a fight. But we need to see the true picture. Without acknowledging the problem how can we fix it?
Bottom line, GC abuses need to stop and we should fight for it as much as we fight for our rights to get GC!

I am so sorry to hear about your experience at USCIS.....but that was brave of you to fight back!
I think you should write to the Ombudsman...do not let this go, we've got to bring to attention the horrors of dealing with USCIS at every stage of our immigration journey. I think there is a call scheduled at 2:00 pm today with the Ombudsman office and USCIS.
What happened with you is really unacceptable.....we follow thier rules and they are unaware of the rules and announcements they make......if USCIS were a company listed on NYSE they wouldnt survive a day.
