So the rule hasn't taken affect yet huh! I will definitely send my application out in premium processing this week. Just worried that I have passed the 45-day time period :( . Does my I-140 have to be approved before this rule is implemented, or just that my application needs to be filed ?

As you are aware there is alot going on right now. The administration is talking about CIR.
Lots of bills with small provisions get talked up or introduced. In fact that happens every year if you look back. We keep an eye on what's moving and where the effort is needed. We do not want to waste our resources and effort if something may end up simply being a placeholder or a position statement.
In a nutshell, there will be fax campaign when we are advised (by lawmakers, lobbyists and friendly advocacy groups among others) and we determine that it is needed and will be effective.
Thanks for the response Paskal. However I still do not underststand why IV is not encouraging everyone to send faxes and register their support via the AILA site. As I have understood AILA has been a leader in this effort for immigration {see July 2007}. If you are trying to say that the interests of AILA and IV are not exactly the same - that is to be expected - no 2 organizations can ever be the same - BUT - surely we can come together to form and pursue some strategic interests. I see that with regard to these bills IV and AILA interests meet. Further if readers @ IV send messages via AILA Action Alert then IV resources can be saved to follow the path that you have described above.
Finally, the bill may be a placeholder or position statement, but in the end we need to demonstrate the numbers - highlighting this bill may eventually lead to some worthwhile convergence in the CIR - I think no opportunity need be lost in this process and the more we highlight our position and condition the more visibility we get.

Currently before the Senate, the measure would allow undocumented immigrants to remain in the United States and earn a chance to apply for permanent residency. An alternative bill that already passed the House of Representatives would turn the country�s 11 million undocumented immigrants into criminals, subject to arrest by local authorities. �If you are an undocumented immigrant in the United States, at the moment you have two choices: You can either stay put and hide, or you can lose everything you have,� said Kelly Fincham, executive directors of the newly formed Irish Lobby for Immigration Reform, which organized the meeting at St. Mary�s Help of Christians Catholic Church. Fincham urged those in attendance, even ones who cannot vote, to call or e-mail their U.S. senators and representatives and ask them to vote for the Kennedy-McCain bill. �Do you really want your future to be decided behind closed doors in Washington, or do you want to have a voice?� she asked. An early indicator of the success of her group, formed in December, was the attendance of U.S. Sen. Charles Schumer, who received a standing ovation after addressing the Friday meeting. �If we were to cut off immigration in this country within two, three or four generations, we would become a tired, stagnant, stratified society,� he said. Congress is expected to pass sweeping immigration reform legislation later this year affecting America�s estimated 11 million undocumented immigrants, of whom around 40,000 are Irish. One version, which already passed the House of Representatives, is an �enforcement only� bill sponsored by Representatives James Sensenbrenner (R-Wis.) and Peter King (R-N.Y.). Known as the Border Protection, Antiterrorism, and Illegal Immigration Control Act, the measure makes it harder for legal permanent residents to become U.S. citizens by allowing government officials to deny naturalization applications based on subjective information or secret evidence. The measure intensifies sanctions against employers who hire undocumented immigrants and requires them to confirm the authenticity of their workers� Social Security numbers. It gives local police the power to enforce immigration laws and penalizes states and cities that protect confidentiality of immigrant crime victims and witnesses. Other provisions would make drunken driving a deportable offense and mandate the construction of five double-layer border fences at a cost of $3.2 million per mile. The Kennedy-McCain bill, known as the Secure America and Orderly Immigration Act, was introduced before the Senate last year by Senators Edward Kennedy (D-Mass.) and John McCain (R-Ariz.). The measure would permit undocumented or �illegal� immigrants currently living in America to obtain work visas for up to six years. They could apply for permanent residency after paying fines, passing a background check and completing a period under a temporary visa. LOL, I know. I really regret that I wasn't on these forums years ago, I wouldn't have done so many mistakes. I was thinking "what all these dudes on these forums know? I got a big lawyer with tie and bunch of certificates as best of the best of the best." The life taught me totally opposite.
Except IV all the other forums are in lawyer's websites. So without lawyers we won't get lot of useful info either. But I do see lot of activites in IV forums related to green card than others which is good we are growing on our own :D

Friends, I already have expressed the views regarding Recapturing/ temporarily increasing Employment Based Visa Numbers for Greencard, on change.gov website . I have been getting E-mails from Transition Team. I have pasted this recent E-mail which is about Meeting with Transition Team. I think, IV Core Team members or/and people living around Chicago area should arrange meeting with Transition Team, and express and suggest our ideas regarding Recapture/Temporary Increase EB greencard Numbers to clear the backlog.

This is good news..But the Damage is already been done..in the past.....
I guess DOL had some 300K cases pending when Backlog center started..It adjudicated some 150K till now.( Rough Estimate) and still 150 K left.
Even if considering 10000 Labors been substituted till now ...Imagine the wait period for rest of us. I wish this law was enacted, when they started Backlog centers..
Anyway..something is better than nothing....Hope for the Best...for new laws regarding SKIL,CIR Etc..atleast filing 485 when Visa numbers are not available..

Good job in starting this thread. I got frustrated like this a few months ago for the same reasons that you & the other members have mentioned here; it definitely resonates with mine. So, recently I have decided to move to Australia by applying for a PR and plan to be there for a few years before eventually moving back home.
This is what I'm doing right now:
[1] Working on my PMP cert. [2] Will be starting a business outfit in Chennai shortly, by the end of this year.
Come on fellas, all of us in this thread are so capable of achieving great things. Please don�t let something like this stop you from achieving what you are truly capable of. I�m not suggesting anything, but look at whatever options that is available in front of you and I�m sure you will find a way out!

I see soft LUD's on all our family (4) I-485 applications today. This is the first LUD I have seen since 11/29/07! My wife got a RFE message. I have to wait for this RFE. I and my kids do not have any RFE messages though.

There is also a 7 percent cap for each country. The sum of family and employment visas for china and india cannot exceed 25,000 approx as long as ROW is oversubscribed.
IF excess visa from EB2 ROW overflows to to EB2 china/india, this would clearly violate the 7 percent limit as the sum total consumption of visas by these countries would be well over the 7 percent of employment visas. Unless the overall demand for employment visas is less than what is available, the 7 percent would clearly apply.
The only thing that I feel might happen would be any unused EB1 china/india visas flowing down to EB2 china/india.
There is some massive confusion here. The Immigration and Nationality Act also says the following for EB3

Read the term "Not to exceed 28.6 percent". So EB3 can't exceed 28.6 percent which means unused visas from EB2 cant all go to EB3. Since EB2 ROW is current, the unused EB2 visas should be coming to EB2 India & china as per AC21 law.. no?
We shouldn't assume that USCIS is too dumb to follow the law..
IF excess visa from EB2 ROW overflows to to EB2 china/india, this would clearly violate the 7 percent limit as the sum total consumption of visas by these countries would be well over the 7 percent of employment visas. Unless the overall demand for employment visas is less than what is available, the 7 percent would clearly apply.
The only thing that I feel might happen would be any unused EB1 china/india visas flowing down to EB2 china/india.
There is some massive confusion here. The Immigration and Nationality Act also says the following for EB3

(A) In general

Could you please let me know when was your visa appointment and how many days it took before you got your passport. Mine was 6th Dec and no update from consulate yet.
It took 7 working days for me to get the passport back. My wife also applied for H1B and it took only 2 days for her. I think it differs by case and how complicated your situation is. The reports in murthy said they should have every information after 2004 in PIMS database. Any query for the record before 2004 may not be present and it takes a couple of days atleast to update the database if a query is made. It's better if you have atleast 10 days time after the visa interview.
The officer questioned me about my employer in US during the year 1999-2000. So it is entirely possible that they may check your old H1s/L1s etc., So plan accordingly to avoid any further grief.

You are right on - most of conversations/analysis on RE market in India (especially Hyderabad which I am familiar with) center around how NRI/IT employee money has spurred the prices. its a big urban legend. Majority of these "investments" were with black money - corrupt govt employees, local businessmen, and politicians of all parties, and ultra rich actors. They saw a chance in converting their black money into white and pumped up into RE projects as "investments". I saw a report somewhere which said that these black-money transactions can account for atleast 33% of RE transactions in hyderabad (with another 1/3 coming from companies/FII's and only the other 1/3 from NRI's + local rich professionals like IT employees/doctors/lawyers etc). In the apartment and SF homes market most of the projects are in the mid-way thru completion -with majority of apartment projects scheduled to complete in 2009-11. During that time there will be abundant apartments with not many people living in them - expect to see rental prices go down even more.
Of course these investors would eventually try to cash their assets - and deman vs supply equations change dramatically to drag down prices. In addition to this - the current global economic conditions are bad (to put it very mildly) - the argument that it will not touch India may not be correct. Our economy is a lot smaller than other economies like US/europe and depend a lot on those economies - more financial companies bankruptsies would affect IT companies revenues. Also there were direct investments from some of the failed companies in India - for example Lehman Bros had a investment in one of apartment project in Hyderabad. Morgan Stanley, Merrill Lynch, etc. all have tie ups with RE companies with huge "promised" investments. Now that they themselves are in trouble - dont think that they would venture into indian RE market anymore - this can also potentially drag down prices.
I could be wrong (was saying that this would happen for last one year - it didnt happen so far ;)) - but I think buying an apartment/house in Hyderabad/Bangalore/Chennai now in 2008 as an "investment" is not a great idea. If the buy is to live there - then its another matter (I never look at my home as an investment - its more of a life style choice whether in India or in US).
On the same note.... On my last trip to India, Hyd specifically...I went around and asked some people I knew for an estimate on a property...I saw people just pulled the numbers out of thin air. I donno how they came to the number, there was nothing to track the real value, like revenue records etc.
I think this also causes the bubble we are seeing, as some people who have cash and are willing to pay may buy it at that price and that will cause people to think that its actually worth that much.

Guys, please make mention about the wastage of estimated over half a million visas over the last decade due to bureaucratic and processing inefficiencies at the USCIS, while we have been waiting patiently.
The best outcome for us in all honesty would be a visa recapture legislation to get those of us at the 485 stage out of the system.

IV tracker shows 3000+ EB3-I applicants, however, it is not a good tool to make analysis off of. The sorting function does not consider month-year combo. Anybody knows how to download the data to run your own post processing??

In addition to our drive of sending out letters to the respective lawmakers, what does the group think of visiting one of the local Dept. of State offices in-person to get answers to some of our questions?
1. How is the visa spill-over from EB1 to EB2 being distributed, are there no chances of EB3 candidates receiving a portion of it?
2. What is the rationale for EB3 being unavailable (or moving at snail pace when available) when EB2 dates have been moved to 2006? (Please don't get me wrong, just asking questions)

Agreed that this will throw out all the crappy body shoppers. This is what we need in future not to make it difficult for future h1-b or other people. We should infact support this bill as this will weed out many Indian Body shoppers and benefit everyone.

If you lose your job today you will be going to these consulting companies only to beg for a job. Once you get your green card you will be starting one yourself if you are smart.
