i seriously doubt if the folks out there in uscis analyse the way we do here in these forums. think for a minute... if they work so sincerely and intelligently, they wouldnt be working for 20$/hr. wish there were performance based payment schemes for these folks.

Took Atlas America due to their "acute onset of pre-existing clause". Mom got pneumonia 3 weeks after coming to US in April last year. They declined to cover hospital bills saying it is a pre-existing condition. Doctor's opinion was she acquired it due to cold weather and highly improbable for someone to have it not get sick for 3-4weeks. Insurance did not care. Still paying the bills.
If the insurance doesn't cover these cases then Atlas America is of no use.

What i think is add this in your short term goal:
In case we need to go back we should have atleast a flat (completely owned) to live and work.
This is the minimum advantage of coming to different country to take all these struggles.

If you look at the ICE's public releases you will see they start investigating a case months before they announce their conclusions. I know in some cases the employers will be able to get away with small fines but we should not let this stop us.
I agree. There haas to be a start. Like how Obama has promised he will make corporate CEOs accountable for the mess they create and move on, we must also jump start the community towards cleansing the system.
The CEO level corruption, if held accountable, we will see less of layoffs etc.. and we can see the good old days permanant jobs that are "really" permanant

Throwing money at scholarships and education incentives dont make people choose a profession they dont like. If they want to be lawyers and doctors and managers, they wont force themselves to go for tech degrees and diplomas just because they get thousands of dollars in scholarships.

I recently did a online AR-11 change for both myself for for my wife. Saw a LUD the next day. After a week my wife got a RFE . Dont know the details yet. Iam not sure if the AR-11 triggered anything. Before that, i never had any LUD after 2007. Sitting with my fingers crossed.Mine is in NSC

Any idea why it's important for the attorneys to notify USCIS that I'm no longer a H worker? The petition would expire next March anyway...
Its a USCIS regulation (8 CFR 214 2 (h) 11) that your employer/lawyers are following, which requires informing USCIS if you are no longer working in H1B status for any reason (got a GC, layoff etc):
(11) Revocation of approval of petition--
(i) General.
(A) The petitioner shall immediately notify the Service of any changes in the terms and conditions of employment of a beneficiary which may affect eligibility under section 101(a)(15)(H) of the Act and paragraph (h) of this section. An amended petition on Form I-129 should be filed when the petitioner continues to employ the beneficiary. Frankly, after mumbai attack I have been a different person. I come to this forum to learn and provide any information I can provide. But it bothers me to see few jerks like mirage who don't have any clue of how things work, and they just start posting on the forum "remove country limits, remove country limits, remove country limits, remove country limits, remove country limits, remove country limits, remove country limits" 30 times a day, as if that will be sufficient to remove country limits. And in more ways this uneducated style bothers me. I will try to ignore it and go my way.
I am right now going to speed dial that other side of me, good and informative side.

the mailed date was recently added as a column.. till now ppl were using receipt date column as application reached.. wait till fp dates and notice dates get populated...the earliest i have seen is for ppl current in june who have a receipt date of 06/29

I was able to talk to IO in TSC. Very nice IO (male). He really took time to look into my case.
First he said my case is preadj. , Than he mentioned my I-140 is under EB3 as per computer records.
I told him, i have the copy of my approved I-140 and it is under EB 2 category. he put me on hold for like 4-5 minutes. Came back and said he has passed on the info to IO looking into my case . He asked me for Reciept,alien # ets. on my I-140 BUT God Darn it, i didint have the document with me at that time. He said, i could call, ad give it to IO . I was so MAD!!!
After 30 minutes of searching, i found my approved I140 from 2006.
I called POJ method Less than 2 minutes i spoke to IO ....they dont disclose the name.
I explained my situation again and gave him all the info .He even asked my contact phone no.
i gave it to him.
I dont know , what to do next. Do you think they really pass in the info to IO reviewing the case?
Should i call on Monday.
Man! this weekend will be a GRIND!
I wish , i had the I140 handy.
So all of you there,

I know that with a deluge of applications, the question I am asking might not be relevent in the current scenario (July filers), but what is the historical EAD processing time? I know they say that USCIS will issue one within 90 days, but does it always take 90 days or is lot lesser?
I remember when I got EAD during OPT, it took like 30-40 days on average. Does the same hold for the EAD for EB too?

AC21 doesn't contradict any law. AC21 memo is a real memo. It provides guidance for areas that are not clearly defined. So no point in comparing AC21 memo against the latest illegal memo by USCIS.
Memos are for interpretation of laws by USCIS. Any memo is advisory in nature and does not have force of law. These memos, unless challenged and turned downed by court or withdrawn, are valid.
Your saying that memo is illegal does not mean anything more than your personal opinion.
H-1B petitions have denied in past based on employer-employee relationship, unable to specify duties at end client, and self employment cases. If you are interested, let me know, I will put links here.
PS: This does not mean that I personally agree/disagree with the memo. This is just to show the legal aspect of it.
