In the US for 11 years now. - 7th year H1B
Thanks for starting this topic!!! This could be an emotional thread for a lot of us who are still waiting for this rediculously long process of GC!!!!
More frustrating when:
Waited for 3++ yrs for the labor cert (PD Sept 2002)
Just submitted I140 (6/2006) but have to endure the fear that my EB2 will be kicked to EB3, which means RETROGRESSION!
With H4, wife cannot work. Going to school is too expensive..i can't afford it with my small salary
Stucked with current company...being under appreciated and under utilized by the current employer...not a place for me to build my CAREER!!!
Have potential contract jobs/independent consultant positions available (recruiters contacted me) which pay 50% than what i am making now...but can't accept those offers bcos of GC!!!!
So so tempted to return home for good (sick and tired of the WAIT), but Everyone was saying "u had waited for years now, so why not wait for another year or so to get it..don't waste the golden opportunity" But...but...is it really going to be just another YEAR? :rolleyes:

2) Filed for I-140 . Cannot file 485 now.
3) H1B 9th year going on.
One good thing I did ,I bought a house in Dec 2002.Now If I sell the same house,I will get minimum 100K profit. I will get good appreciation now.I recommend you guys to buy a house now. It is the best time to buy a house,because it is "Buyers market" now ! You can make some money if you sell it later...

As you may know, we are just one more week away from hosting Advocacy day in Washington DC where about 170 members of Immigration Voice will conduct nearly 250 meetings with offices of Senators and Congressmen. Such events cost money. If we have enough contributions, we can spend as per our budget of nearly $ 50,000. If not, we will have to cut back on the event spending and reduce the magnitude and size of the event.
If you are not coming to DC next week, please do your part and contribute funds to Immigration Voice. It not only finances the event properly, it instills pride and confidence in the members who will be there in DC that there are thousands of willing supporters behind them who could not be there physically but are 100% with them in their determination and resolve.

Regarding the 1st point, we, or at least I, am already trying to recruit as many people as I can, also posted IV posters in a few places.
Does anyone know how the illegals got word out about their rally across the country, or specifically press coverage about it? If so, we can try to use the same source, not for a rally, but to get IV's name out and talk about our major issues reduced to 2-3 points, so it is not confusing for the public.
Regarding, 2nd point, I think we can all contribute small amounts, say $50-100, but unfortunately most of us are stuck in low paying jobs. If we can get employers involved, that could be a better source of funds. Seriously, I dont expect many employers to contribute, but maybe academic employers who are losing funding because their H1-b employees are not authorized to get it, might be more willing to contribute.
Also, is anyone aware of any Indian American politicans, perhaps local Congressmen, that we can contact? I think I read recently of one in Texas.
Here is a story on a senator from Delaware who seems to be suportive of Indian Americans, although the story is on how he made a blunder talking about them:

I agree with rheoretro, the first thing that any member feeling helpless here should do is to get more publicity for IV. Talk to people in the same situation
who are suffering because of backlog or cannot file because of retrogression.
Please urge all your friends, influence them to contribute to IV.
Lets continue doing that on a daily basis and then if you feel you can do more, start writing to your local representatives, senators, house members.
I have written atleast 2-3 times to my senator on numerous occasions.
I feel, your words, combined with your thoughts about how this affects you helps a lot in conveying and putting the message across.
I just got sending a email message to my senator here, I am going to follow it up with a letter.
Email message reads like this:
Dear Senator Boxer
I have been a legal resident in state of " " for close to 5+/X years and I have been a legal resident in the USA for a total of X years.
I am a legal immigrant, whose application for permanent residency has been pending for the last 3 years.
The U.S. government makes only a certain number of immigrant visas (green cards) available each year and these are allocated among the various immigrant visa categories and countries from which applicants seek to emigrate.
Retrogression: For the past few years, the number of immigrants approved for employment-based immigrant visas has been lower than the number of visas available, resulting in no backlog in visa numbers. Recently, the DOS has seen far more immigrants approved for employment-based immigrant visas and has run out of visa numbers in certain categories, causing a temporary backlog or "retrogression" of visa numbers.
EB-3: This visa category includes employment-based immigrant visas for:
1) professionals with a bachelor's degree
2) skilled workers in positions requiring two or more years of experience or training
3) unskilled workers
Chargeability: Immigrant visa numbers are further apportioned among the various countries from which applicants seek to emigrate. Each country has a limit and each approved applicant is "charged" against his or her country's limit.
Also to complicate the matters, there are those folks that came here illegally that were allowed to change status based on 245(i). Every year in Oct (start of new fiscal year for the govt) 140,000 visas are made avaible for EB3s. These 140,000 visas are divided amongst the different nationalities. Some visas are now going to be eaten up by the surge of 245(i)s from 2001. Irrespective of the the nationality of the 245(i) applicants, they are impacting every category witihn EB3. That is the main reason that almost all EB3 categories have retrogressed and will remain so for a while. Its a grim picture but thats the reality.
We need some intervention from Congress, otherwise people like me will have to wait for years - possibly half a decade or more
I support your opinion that there cannot be any amnesty for illegal immigrants, but there should be emergency relief for legal immigrants stuck in the logjam for years. We ought to make it a little fair for legal, honest and law-abiding legal immigrants.
Please support any bill that gives a temporary relief to legal immigrants (especially Employment based applicants). A temporary increase in the number of Visas allocated to the Employment based categories can substantially alievate some hardship.

I checked with both pediatrician and Civil surgeon and they both are of the opinion that TST test would not impact a nursing mom.
My attorney told me that my wife needs to get back before her scheduled trip. This would incur huge costs plus it would be difficult to get the seat arrangements. ( We have a twins and we have seats with bassinets for the infants). My father is also travelling with her.
Is it possible to ask 1 month extension for RFE based on the difficulties. I'm EB3 IND PD 2003 and I dont think our I-485 is waiting for adjudication any time soon.
I've scheduled an infopass appointment tomorrow. What are the chances of getting an extension when I present my case to IO?
I'm worried and it makes us very anxious.

1) did you talk to your lawyer?
2) if # 1 is ruled out or of no use, I would personally draft a letter showing that she is travellling right now and with kids and it would be extremely difficult to get her TB test done as you cant get it done by that RFE due date. add some more stuff telling your situation as to why she cant come right away due to the stuff you mentioned (kids/babies ). IAm sure you WILL get it exteneded.

I collected my passport with the visa stamped yesterday from the VFS center in chennai. I sent an e-mail on tuesday to the consulate and i got a response from them saying it could take another 4 days approx and the delay was caused by the recent change and the introduction of the PIMS database. It looks like they are digging through your old records as well.
For those people whose passports have been delayed, it's most probably due to the PIMS database and i suggest strongly to send an e-mail with the subject line "PASSPORT PENDING for more than 5 days" and you would most often get the response the next day. Do not call the consulate as they don't tell you what you want to hear. The person who answers the call is an indian and he/she would not have much information to give you.
Could you please let me know when was your visa appointment and how many days it took before you got your passport. Mine was 6th Dec and no update from consulate yet.

There is No sense is passing a rule/memo like this where the consultant/Employee is affected badly.USCIS changes their views and rules on a need to need basis which should be struck down by the court of law.We as immigriants to US and we have every right to fight this rule and also need to support the need to revoke this rule.
Even a criminal gets a chance to plea in the court as not guilty,but we dont get a chance beyond the immigration counters.We continue to contribute so much tax dollars and all of that shouldnt go in Vain.People have lives and Families and they can never build or continue the future invested here in US.
I agree that the rule will make sense for new H1�s or extensions but i dont not agree that it should be passed on people randomly.USCIS should force such a rule on the Employer and not go against H1 Employees.
This Rule should be taken by employers to implement new standards of practicing consulting and not try to find loop holes in the system.Obviously we should have seen this coming which is ripple effect of all the employers exploiting the Consulting business.

If they dont count Dependents we all get GCs very soon . Unfortunately all dependents even kids are counted under employement category ..
One change - Counting a number for primary applicant can change thousands of lifes each year .
This is really sad that they count all dependents under employement category. USCIS should treat all categories in same way. Can't we raise this issue?

It has been determined that based on the current level of demand being received, primarily by Citizenship and Immigration Services Offices, there would be otherwise unused numbers in the Employment Second preference category. As a result, numbers have once again become available to the India Employment Second preference category. The rate of number use in the Employment Second preference category will continue to be monitored, and it may be necessary to make adjustments should the level of demand increase substantially.
May be EB2 India and China can see some movement in July VB published in June.
This piece in VB is telling that the unused numbers in EB2 will be given to the retrogressed countries in EB2. The VB when it defines the categories, also defines EB2 as 27.6% of 140K and what ever is left over from EB1. EB1 is current for some time now and EB1 also circularly gets unused numbers from EB-4 and 5 which account for around 20K. I have been under the assumption that EB-3 ROW must become current for EB-2 retrogressed countries to move significantly forward because of spill over and not by the quota they get every quarter. EB1 is current for some time now and EB1 also circularly gets unused numbers from EB-4 and 5 which account for around 20K. My thoughts are here (http://nixstor.blogspot.com/2008/03/thoughts-on-april08-visa-bulletin-and.html). I have been under the assumption that EB-3 ROW must become current for EB-2 retrogressed countries to move significantly forward because of spill over and not by the quota they get every quarter. It does not sound like that. Am I just hallucinating or Am I just reading too much or Is it just the VB as usual unpredictable and capricious?

If they are smart they should pass SKIL bill.
Senator Bill Frist introduced the modified senate version of CIR.
That includes "Subtitle B--SKIL Act" SEC 521 to SEC 532
This was done in the senate session before elections:

Hope this new CIR goes to the conference for House to negotiate.

You may wanna read "Six thinking hats" by Edward de bono. He talks about having critical thinking hat(black hat) during brainstorming.Lets have some people with black hats here.
I have read the above book and other books (lateral thinking, ...) by Edward de bono; he has written a lot of (non expensive) books. I strongly recommend his books to the open minded reader.
btw I thought anand26 was banned from this forum. I am not too far away from being banned as well. I got a post deleted by the admin already without any notice.
I should also be banned soon. My post was not published on Friday. I did not praise logiclife for the Friday episode. I do understand that my question's will not get answered.
On the other hand, I see absolutely no content in anand26's posts. Such posts are a complete waste of time for our cause. There is no point in responding to such posts if you do not agree with it. We wasted yesterday on anand26 and friday on someone else.
However, the posts should not be deleted and persons who agree should be allowed to debate. This will not hurt IV. What is hurting us is the time we spend in responding to them.

Those who got labor sub and got their GCs already must reapply within XX days or their GCs will be deemed invalid? How do you think will such a rule be?
If labor substitution, applying 140 in 45 days etc.. are the kind of rules that are being framed, it is mainly because all the companies started exploiting these rules.
It can be hypocratically argued that Desi companies only sell labor and misuse it, but from a larger perspective, any company including those multibillion dollar companies may actually misuse labors ie like HR will use sub labor for friend, lawyer may educate HR about the loophole and they will use it as a card for new hires. If such a thing is stopped there is no room for misuse of any form. We have to thank Desi companies because in someway, by totally exploiting the loophole, they helped this cause.
45 days in filing 140. Believe me, such deadline is definitely achievable. 140 is a simple process and all that is needed is company audit and tax reports. I guess time will be given to those who already have labor certified and not applied for 140 for whatever reason.
Such a rule must come even for filing 485. So that companies don't drag that too.
Like most of the people have told earlier, changes are coming, a lot of changes are coming in the system and people are working in the background to streamline the system.

Exactly.. You apply now.. no way it is going to get approved in time.. substitution approval takes anywhere between 4 months to 1 yr. Most common I heard is 6 months. you try to slide just under the door.. they aren't going to be happy abt it..
