I was able to talk to IO in TSC. Very nice IO (male). He really took time to look into my case.
First he said my case is preadj. , Than he mentioned my I-140 is under EB3 as per computer records.
I told him, i have the copy of my approved I-140 and it is under EB 2 category. he put me on hold for like 4-5 minutes. Came back and said he has passed on the info to IO looking into my case . He asked me for Receipt,alien # ets. on my I-140 BUT God Darn it, i didint have the document with me at that time. He said, i could call, ad give it to IO . I was so MAD!!!
After 30 minutes of searching, i found my approved I140 from 2006.
I called POJ method Less than 2 minutes i spoke to IO ....they dont disclose the name.
I explained my situation again and gave him all the info .He even asked my contact phone no.
i gave it to him.
I dont know , what to do next. Do you think they really pass in the info to IO reviewing the case?
Should i call on Monday.
Man! this weekend will be a GRIND!
I wish , i had the I140 handy.

Going by your id registration date, I am presuming you are new to this site and do not know the history of what transpired over the last few years. There are hundreds of threads/discussions/posts where these arguments have been made and answered. We (all of us) are seeing increased interest in solving our EB-GC problems because of hopeless retrogression and a ray of hope in terms of CIR. Just because one shows new interest, you cannot expect immediate consolation and agreement on what you say/propose.
There were numerous times when members felt a specific campaign and/or item needs to be pursued. Serious discussions happened and eventually the advice of core which gets its info from various sources supported or not. There is nothing to stop you or I from pursuing an option.
I for many months did not understand the rationale and the way the system/politics function in this country. I still do not understand. BUT I do understand certain basic things:
1. How laws are crafted: the process, the resources involved and other technical matters.
2. Lobbying and advocacy: What role they play when dealing with lawmaking. Go read about the healthcare bill and what is happening in the Congress, lobbying, interest groups, associations, ordinary citizens, PACs, non-partisan groups. you might get a taste of what this is all about.
3. Systems: USCIS, DOL, Homeland Security etc
4. Politics: The main parties involved (Dems, Republicans). Who reacts to what and what their core values are. What is left, middle, right. who is where.
5. How national and state politics matter.
I am going to generalize here a bit: A lot of members who get their info from CNN or Google Reader or other 'mainstream' media sources might get either a black or white version of news/happenings. I quickly realized there are numerous shades of gray when dealing with Washington DC. How politics of left, middle and right come into play, which Senator or representative votes which way and why, etc. Listening to a press conference and reading an article on CNN does not give one insight into politics. These are the 'backend' intelligence which I trust core to know and advice us. I do not expect them to reveal their sources nor specific tactics. Most often than not, there is a rational explanation.
In this specific case, my take is: AILA with all their nobel intentions are in the 'business' of making money from folks like us and our employers. There are many shades here and it is not all black or white as it may seem. Like a member pointed out, AILA does not represent just EB or legal immigration. There are other things involved which may be detrimental to us (you do not want to be bracketed in the same category as illegals or want amnesty as an example). Apart from this, timing is critical.
One of the most important parties apart from Lawmakers is our opponents. Anti-immigrants who wants to know tactics, strategy: who we are calling, whom we are faxing, whom we are meeting, how we work, etc. They doggedly follow and couteract many items. For every fax/call/email you send there might be a counter reply from anti-immigrants. When core suggests confidentiality and secrecy, those I believe are not some magic/secret cloakish things but a matter of pragmatic reality. That is the world we are in and to be successful, we have to deal with those realities.
Giving out updated information is not as simple as it seems. These are steps which can be easily retraced and antis can quickly use those steps and backstab us, crippling our efforts. Updated information == tactics. My last point is about: Donors Vs Non-donors. Do you know that you need not be a donor to volunteer ? Try getting in touch with folks at IV. There is a lot you can do and you seem to be the right person whom we need on our side. I urge you to contact IV.

ok, I did not take private coaching (not that its relevant to a 3/4 year degree) and we had quite a few lower-middle class students in engineering.
As for poor families - A MCA at IGNOU costs a little over $1000. I'm sure its similar in other distant learning courses too.
that may be the case...but maybe the guy couldn't afford the 4 year engg...did the way way cheaper 3 yr bachelors...then worked ...made some dough...decided to study further to advance...so did MCA ( repeating a 4 yr bachelors is not sensible or economical at this point)
This is all speculation ofcourse...the point is we don't fully know the person's circumstances and should not judge based on face value of the degree...if the person is talented he/she will be retained by companies who want to keep them.

It took me around 4 years. EB2 India, started as a scientist later physician and endless headaches ...... but its over now. Got my card yesterday. Its an amazing stress relief and confidence booster.
I could have tried EB1 too but wasnt sure how it would turn out hence stuck to EB2.

For those who are waiting: Keep pushing and thinking of new ways of making this work. if you are EB3 try to become EB2 and even EB1. In the end all that matters is getting the card.

Bashing the system and correcting the imbalances are correct. But some people in this forum are targetting individual persons(some times Senators) and doing personal attacks some times bad words also(I can see atleast 100 postings like that). No one realise the fact that same right we were not able to get in our own country. Can anyone talk to MLA or MP in India by phone when they want if any issue?. So we need to appreciate that we got extra freedom than our own country. If we want to correct problems in the system we have to fight with patient with point in mind that we are aliens compared to those who came here 20 years or 100 years before us.

I don't think there's a difference in time for EB-2, EB-3 or EB-1 labors. Its takes anywhere from 1 week to 2-3 months. My company filed 2 labors simultaneously one for me and one for a collegue. My friend's got approved next day(less than 24 hrs) mine took 70-80 days.

Abuse does occur but the evidence indicates it is limited and of a character that can be handled within existing laws and regulations.
In fact, the amount of back wages owed to H-1B workers, small as it is, actually fell between FY 2005 and FY 2006. Moreover, the aggregate total of back wages owed is almost infinitesimal placed in the context of a $13 trillion economy. In FY 2005, only $5.2 million in back wages were owed to H-1B professionals based on DOL investigations and the total dropped to $4.6 million in FY 2006. Consistent with other years, 86 percent of the cases investigated (104 of 121) in FY 2005 resulted in no civil monetary penalties being assessed. In FY 2006, no civil monetary penalties were assessed in 89 percent of the cases completed (14 of 133).
The data show the vast majority of cases investigated by the Department of Labor have involved only paperwork violations, not willful abuse, and that back wage payments were generally fairly small. The proportion of H-1B professionals owed back wages is also small. I was transferred to a IO yesterday. She was rude, told me that I should not be calling since they responsed to the first SR that was opened by my attorney on 09/01.
Not sure if you read the other thread, but I have got 2 responses from USCIS so far - one for inquiry that was sent when I took the Infopass and the other one that was opened by my attorney.
Response that I got for inquiry from my Infopass was " Based on the additional documentation provided, your case qualifies for expedited processing. You should hear back from us in 60 days. If you do not hear back in 60 days, please call us back".
I havent provided any documentation to them in the last 2 years, after my FP was done in September 2007.
So when I talked to the IO, she read out that message to me and in a subtle way asked me "What part of that message do you not get"?? I was trying to explain the situation to her, and before I could finish - she said "Sir, I got to move on and take other calls, please dont call back before November 15th".
And then she said the part that chuckles me the most - Sir, is there anything else you would like to me repeat, or do you have any other questions.....??
Hell yeah, I only have one question - when will I get the magic email?? :o

Most of the people on Immigration Voice come here for legal advice regarding immigration, what if IV negotiates a good rate with 3-4 Immigration attorneys and recommends those attorneys to members? Attorneys would get business due to IV recommendation, IV will get referral fee ($100-$200) per referral and members will get discounted rates from good attorneys.
Do you think this can work?

I know an instance where a big american pay roll company got people from india on business visa and made them work for $50 per day and the poor guys were slogging more than 10 hours a day.
Ofcourse the manager is a desi ..
