My wife couldn't do TB test since she was pregnant when we filed I-485 in Aug 2007. Now she is in India and be back only in the first week of June. If we receive an RFE for her TB test ( my PD is EB3-I Oct 2003), can we request an extension for RFE? Is that possible?

My fear came true today. USCIS issued a RFE for my wife's I-485 TB test and she is in India right now. RFE has May 6th deadline and she would be back on June 3rd.

I totally understand the emotional point of someone being want to be a Indian Citizen but I have to stress there is no other country in the world like U.S.A. This is the country where every human being is treated with utmost respect (don't try to show me exceptions - U.S. is a country where most of things are close to being perfect imaginatively), have freedom to say anything they want without getting intimidated and U.S is a country I believe will be the last bastion for humanity when terrosists/fundamentalists spread their tentancles and take over the world by force or other means (if not now probabbly in the next 100-150 years). Hypocrisy is relatively less. We Indians live in a dream world nurtured by the Indian politicians, who try to inject doses of patriotic non-sense into the masses while they themselves stove away million of dollars in Swiss banks. 70% of Indian population lives below poverty line and the educated masses of India think that their country will become a super power by 2020. Politicians like Mayawati play caste politics and dream of taking the top most post while our liberal media, without a wee-bit of shame, extends its highest support for them. Corruption is part of our daily life and we are part of the everyday corruption but we still find no fault in our society. Our population growth is beyond control while not a single politician is concerned about the stress it is going to create on our natural resources in the future. Our education system is in shambles but our great politicians fight for increasing the reservation system to different castes just for the sake of garnering more votes. And the list goes on. Alas���God help India.
FYI: I am a Indian and haven't even started my greencard process, for the same emotional reasons you mentioned, intending to R2I soon. Given a choice and circumstances, I would have opted for U.S.C as "I have no hope for this world neither do I wish for it" - quoting Bhagawan Krishna from Bhagavad Gita.

Just so, everyone understand, I am not trying to find fault with IV or its members. I am trying to do, what you can call, soul searching.
We have around 25000 members. Why only 25000, when we know there are millions out there in the same boat. What is stopping them from joining IV and contributing? Of all these 25000 or so members, we only have around 4000 letters sent for Admin fixes.(May be I am wrong about this number, but I believe it is around that range.) What is preventing the others from doing so?
I strongly believe, that the answers to these questions might help IV in the long run, with more members and possibly more active members. Once we get to that point, IV will no longer be an organization, but it will be a MOVEMENT. Chances of success for a movement is always better than that of an organization. That is what I believe we should try to achieve. I hope everyone agress with that.

A growth to 25K members from 5K is an amazing five folds over a period of around two years. Having said that, there is tremendous scope for future growth. I will let Waldenpond define that, if need be.
IV's focus is defined by you, our members and the larger macrocosm of high skilled legal immigrant community. We need help and guidance from our members to achieve success with issues like what jnraajan mentions above.
Just to temper that thought. Using democracy as a metaphor, it would be great to have all the citizen participate and vote in elections but as we all know that is not the case. We might not have the million strong membership yet and if we use the pareto rule of 80:20 then I believe that we do have the "critical mass" to facilitate change. Change to the currently broken immigration process for the high skilled legal immigrants to USA. Lets marshall our existing resources and deploy them effectively to achieve success. We need your active participation for that.
IVers PM me if you are interested in volunteering, we can talk over the phone too. Let me know.

Absolutely we have to do it through IV. it is not good idea giving personal checks. what happens when Aman submits his federal taxes. he has to mention everything about the money trail. In America everything should be trailable especially money matters.

Can we take the following decision. (this question is for the regular members who reply to peoples queries)
Questions that ask for any help or suggestion will be answered only if the persons signature mentions that they have contributed.
People who dont want to contribute can go to elsewhere and ask questions
It is not fair to expect a member to contribute the moment (s)he joins. It takes some time to understand the impact of GC problems and get a good feeling about IV activities. IV can not post its activities on forums. You will be surprised to know that anti-immigration organizations are well organized.
However, we have numerous members with 50+ posts and 3+ month of membership with no intension to contribute $20 (you will not get 2 Indian Buffet's in Washington DC for $20; it takes $4 (metro up) + $4 (metro down) + $4 (parking) everyday to DC).
I (and other members) have literally begged some of these members. One particular member says (s)he is going back to his/her country but starts posting obnoxious messages after a few weeks.

For my situation discussed above, I took an infopass appointmnet at Baltimore and they couldn't offer a concrete answer since the case is pending with TSC. They asked me to reply to RFE asking for extension and provide supporting documents. I'm not sure if that would be accepted and results in denial of I-485.

Hi guys,
Today morning I was able to reach IO in Texas service center, she is very friendly and helpful. I had two I-140s one with EB3 and another one with EB2. She mentioned that both are not current, I explained her about the PD portability rule and about my letter of request to port priority date.
She said she is not aware of that and asked me to sent the Memo and gave her name and Fax number. I faxed related pages in that memo to the fax number provided. She also mentioned that she will send request I-485 processing unit and will add the comments about the PD portability. Also she mentioned that she will discuss about this PD portability with her supervisor.
Hope this help. I strongly recommend the guys who are current to call USCIS and find the case status.

Write to Mr. Bush (no kidding). They will send an inquiry to FBI and you will get something from FBI NNCP (name check division). If that does not help, file a lawsuit against USCIS/FBI. Or you can file a lawsuit first and then write a letter to save some time. The lawsuit will get things moving. The do-it-yourself guide is located here:

Dont even think about it unless you are a quant and have resources that can compete with the Hedge funds. Commodities do not behave like stocks, you need to be able to model prices using multi variate models. Then there is jumps. You should be familiar with jump diffusion/step functions etc. To be able to model these you will need to use a factor model like the Pilipovic model. Even then it will only be an approximation.
Commodities are purchased as futures. Futures are derivatives and you will need to hedge them. A perfect hedge for a future is 1:1 in the spot. Since there is no arb here you will have to use options. To model the price of an option you will have to be a master of Black-Scholes option pricing model or a similar method like monte carlo simulation. Even if you figure all this out you will have to delta hedge. Delta hedging commodity options is very expensive, you will bleed money. Look up Hodges-Nuberger model for delta hedging options on derivatives.
I suggest a book by Daragana Pilipovic called "Energy Risk", buy it and read it. After that if you still feel you can take on hundreds of computers running parallel with teams of quants modelling prices and programs trading algarithimic models; then Good luck!!

But my fight for what is fair is distinct from my own case and i am gonna keep going.
Bcoz Mr. gctest is Mr. phd, he treats Eb3 with contempt! Now, he will go back and delete all his dirty posts :)

Now I understand. This guy PBECiskillingme bought a substituted labor (used illegal means) to get his application to move ahead. He thinks everyone is like him and thus criticized IV on our forums. It is because of people like him and employers that sell LC, we all get a bad name. He should also be reported to DOL and USCIS.Very strange and insulting conclusions. The only thing I was telling is that there is still time to get labor substitution done. Also there is a risk. Till substitution is banned it's not illegal.

I am a passive observer of these forums. But some of the ridiculous notions floating around here have motivated me to vent. First and foremost, the law as written is highly favorable to people in EB3 categories, even from India. Here is how...
Take my example (and there are thousands like myself)....came to the US 8 years ago, spent 5 years working day and night to earn a PhD on a low (barely sustainable) stipend, got FIRST job saw decent money for the first time 6 years after I came.
Now, compare this to a person working an EB3-job for the last 8 years. Not only does this person do a real job that hopefully provides a respectable income but this person also has the option of moving to EB2 after 5 years of experience. So, at the end of the day in 2008; this person comes out ahead of me in terms of money, in terms of priority date (if ported) and most likely in terms of GC.
There are complaints all over the forum which have the stink of pretentiousness such as �oh..i am a poor EB3 waiting for n number of years� etc etc. What you guys seem to forget is that YOU are NOT an EB3, it is your JOB that is EB3. You have all the opportunities that were/are available to a person who sweated it out in the university system here to gain more qualifications and get an EB2 job. You CHOSE not to. The general discussion seems to center around cribbing about the US immigration system (Immigration by the way is a privilege defined by laws, not a birthright) and then blaming the EB2 crowd when they finally see the system implement the law as intended in the first place (horizontal spillover rules).
All these posts that refer to �my career is over because my gc is delayed� are nothing but a pathetic excuse. Law of supply and demand....if you have a skillset that is valuable, you will be fine with or without GC anywhere in the world. It takes a bunch of documents to remain here legally, all you need is a passport to go back if the system here seems so bad.
For all the attacks that are bound to happen, here is the fodder.....this is probably my first and last post, I haven�t contributed a dime to IV, will work here as long as I like it and if not, India is a great country and provides enough opportunities for any skillset !!

of the 300,000K applications would be between these dates. When DOL adjudicated 180K applications, about half were already abandoned. If roughly half of the applications are approved, that would be 300K Visas including dependents.
An interim relief about 200K green cards will take care of problems tremendesly......But Schedule A is eating up unused visa's.
I feel like, it would be good idea to go for some recaptured visas at (least200K) than fighing for a whole immigration package.

Do you think the drive would have reached its original goal yesterday/early today without the January visa bulletin retrogressing us even further...?
I have my doubts about that... :)
And how far in the past would we need to retrogress to get another funding drive done...?

H1 fees, stay on bench for few months......and never complain...
Now a days many companies send people on L1 visa. On L1 you have no choice. If you can't get H1 in April you are slave to the employer.... also with L1 there is no stipulated salary like H1.... so employers pay whatever they feel like and not market rate.....but since many employees have desire to stick around in US and save some Green... pay of their debts in home country.... they stay with same employer without complaining......
