    leave my indian employer soon. they are saying they have 90 days notice period.... which was set from india. I work in ohio which has "employment at will" law... I am not going to serve the full notice period..... but if they deduct any money..... I am going fight like hell.... planning to complain to DOL and state govt office......I will keep updated on what happens....

    "Employment at will" does not invalidate your notice period requirements. If you have an agreement with your company for a notice period, as long as it is not unduly restrictive, 90 days is probably arguably restrictive, you will have to honor your word.

    I agree too with the original post by pointlesswait !! ..digital signature is good ..or if there is a site which allows people to show their support (I guess there are sites like these) .. also, in the document we should include these points (small and precise document) ..
    - why legals are suffering
    - advantages that legal immigration brings to US
    - the effect of few senior professionals leaving the country etc .
    ..for e.g. ..if a senior programmer or lead gets frustrated and goes back then all this happens ..he / she takes the job away with him ..and in turn trains 10 other people (so more jobs go away). also along with a skilled person - all the investment and taxes are lost ..(for eg ..house + prop tax + living expenses etc etc) .. and the fact that US is turning older (i.e average age ..) etc etc
    and a related point ..each IV member should try to contact 5 other immigrants and tell them about IV ..and they in turn should atleast show some sort of support

    Lets keep this thread to celebrate OP's Green Card and some inspiration for Hopeless EB-3 guys.

    Krish: I agreed VISA recpature and not including dependents will help us a lot, but looking at the current political divisiveness and people focusing more on 2012 election cycle and the campaigning, noone going to touch this HOT POtato of legislative reforms for Legal immigration. Now considering wait until the formation of 113th US congress it is about 20 months time, so do u expect People who are qualified and getting an opportunity to get out of EB-3 mess should wait that long? People already waiting since 2002/2003 PDs and no sign of any legal relief from USCIS/DoS for this hopeless EB-3 india people. Once agian legit porting is the way out to come out of EB-3 india mess, their is no other solution for us. When you compare all retroigress classes EB-3 india is the worst, we are still in April 2002 as compared to other EB-3 categories which are now in July 2005 range. (china is exception to this they are way better than us to somewhere 2004 range). Please dont bring in this issue in this celebration thread, let people cheer something, we already had so many useless threads and verbal arguments on this subject.

    If we do not get this problem resovled who will ? All the members in this forum please start taking active part in determining your future your families future and your kids futures.. please do not be short sighted or procrastinate. Take Action NOW, we can do this, please encourage one more person to join in and contribute, talk to other people who are not aware of our plight and educate them, contact your local lawmakers, be active on the forums, support the core members and each others, come on now guys.. may be all of us cant do every thing but try some things at some of the times and some other things some other times :) -- does that make sense .. I wish I was very rich I would have made a HUGE donation to IV to fight for their cause... I really respect the core members for their tenacity, dedication and inner strength to carry on this effort.. admist so much uncertainity and so many obstacles .. and the best part is .. most of the people who will benifit from it dont want to do much about it ..... ok ..     Banking service is still way behind in comparison to US institutions. ICICI has to compete with nationalized banks in terms of competency and customer service so they surely do better but it is highly openly discriminatory depending on how valuable they think you are to them. Something that exists here but is very transparent. But I am sure ICICI has engaged in many questionable practices from marketing to collection, there have been some lawsuits as well against them.

    I have come across some cases where GC aplication I140 was reopened after being approved. So this is no surprise. While I could not find the reasons fully in many cases, why cases were reopened as people tend to hide the true reasons. I think for GC applications the reasons may have included-- suspicion of fraud/complaint against the employer/Ability to pay after seeing more GC applications in the same company and thus reopening past cases/Bona fide intension of the employee to join the company after seeing some irregularity in the immigration applications/too many GC applications or H1B applications from the same company and thus a red flag for an H1B dependent employer.

    The best solution in such cases is to first find out the reasons and weakness in your case. Each case is different and one cannot generalize. So each applicant will know their reasons. If the case is reopened, then don't panic. But if you get an RFE, the immediately contact a good lawyer and answer it.

    guys - i want to start a new forum on 401K ..

    want to discuss what happens to people who have 401k contribution and want to go back to india

    do we have to withdraw the 401K when we leave or can we withdraw it at a later date..

    Yes she needs to be here to file I-485 and then she can leave and stay there..

    Thanks for the reply, I am assuming she has the same requirements as me in terms of medical , right which means another 2 weeks after she arrives. If she can't make it here in July, can I file under CP for her. Would she then get her EAD at the same time as me. I have been trying to get in touch with my lawyer but he's not there, and I want to make sure I add her in before the dates get retrogressed again.

    In reality, many companies who have subsidiaries abroad can use L1 visa program. But H1B offers flexibility that is much desired by many companies. (It is very less abused compared to H1B). No numerical cap on L1B may not go well with many of us. But I am very +ve that the visas are not issued in anticipatory mode like H1B. And why do companies spend 5K if they do not want to get the worker here? Do they like waste money just like that?

    Logically this highlights the real problem in the system - numerical caps. If the caps are not there and companies can get a visa-on demand, they will not spend 5K per visa on anticipatory mode. Because there is no need to do that.

    So no system is perfect. We have to minimize abuse and act responsibly when it comes to sensitive issues like immigration...

    Agreed, let everybody keep this to topic and stop making personal remarks. I haven't made any personal attacks in this thread. A couple of notorious people are at it as usual.
